Free Speech & Free Speech Zones on Campus: DOJ files statement of interest in FIRE lawsuit

WASHINGTON, Oct. 25, 2017 — The Department of Justice on Tuesday filed a statement of interest in a California student’s lawsuit against his college’s free speech zone policies.

In March, Los Angeles Pierce College student Kevin Shaw filed a lawsuit challenging Pierce College and Los Angeles Community College District policies that restrict student free speech rights to tiny “free speech zones.” The lawsuit is part of the Foundation for Individual Rights in Education’s Million Voices Campaign.

“The United States has an interest in protecting the individual rights guaranteed by the First Amendment,” according to the statement of interest, a brief filed by the attorney general expressing the interests of the United States in a pending lawsuit. “The right to free speech lies at the heart of a free society and is the ‘only effectual guardian of every other right.’”

The statement of interest argues that, based on the facts alleged in Shaw’s lawsuit, Pierce College and the district’s policies and practices violate student First Amendment rights and denied Shaw “his right to engage in expressive activity in a public forum.” Shaw is currently awaiting a Nov. 14 hearing on the defendants’ motion to dismiss the lawsuit.

“I am humbled to have the support of the Department of Justice,” said Shaw. “Their statement affirms what I’ve believed all along — that the First Amendment is essential to American progress, and nowhere more so than on a college campus.”

In November 2016, Shaw attempted to distribute Spanish-language copies of the U.S. Constitution and recruit new members for his student group, Young Americans for Liberty, along a main public walkway through campus. As he prepared, he was approached by an administrator who told him that he could not distribute literature outside the campus free speech zone, a tiny area on campus measuring approximately 616 square feet and comprising about .003 percent of the total area of Pierce College’s 426-acre campus.

Shaw was also told he must fill out a permit application to use the free speech zone. He was informed that he would be asked to leave campus if he refused to comply.

“FIRE is grateful for the Department of Justice’s decision to file a statement of interest in our lawsuit,” said FIRE Director of Litigation Marieke Tuthill Beck-Coon. “As the department rightly recognizes, these policies severely restrict the expressive rights of all students on each of the nine district campuses. We cannot allow the First Amendment rights that Kevin Shaw and his fellow students possess to be taken away by administrative fiat.”

The lawsuit was filed on March 28 in partnership with Arthur Willner, a partner at Leader & Berkon LLP, who is co-counsel with FIRE in the case. In addition to challenging Pierce College’s unconstitutional free speech zone and permit requirement, the lawsuit also challenges an LACCD policy that requires the president of each LACCD college to designate at least one free speech zone on their campus. With approximately 150,000 students, the LACCD is the largest community college district in the country.

“This lawsuit presents Pierce with the opportunity to move to the right side of this issue by ending its unconstitutional violation of its students’ First Amendment rights,” said Willner.

It’s a murder plot out of a spy novel. Kim Jong-nam, the estranged half-brother of North Korea’s unpredictable leader, was allegedly poisoned by two women assassins at Kuala Lumpur airport. All signs point to Kim Jong-un, the rogue state’s leader, as behind the murder.

Halloween Costumes Gone Horribly Wrong

In Augst of 2017, the FBI nabbed two women suspected of robbing banks in nun habits.

Certainly, costumed bank robbers are not new. In 2009, a “clumsy and jovial” Santa Claus robbed a bank in order to “pay his elves.” According to WKRN:

NASHVILLE, Tenn. – An armed suspect dressed as Santa Claus robbed a local bank Tuesday morning and told tellers he was doing so to “pay his elves.”

At 10 a.m., police said the man, dressed in a full Santa Claus costume complete with a hat, beard and sack over his shoulder, entered the Sun Trust Bank branch located at 4809 Old Hickory Boulevard in Hermitage, just north of Lebanon Pike, and approached a teller.

According to witnesses, Santa was wearing sunglasses and the teller asked him to remove them.

The suspect refused, reached into his sack and pulled out a gun.

He demanded money and told tellers if they put dye bombs with the money he’d come back “kill everyone.”

He took the money and fled, telling employees and customers in the bank he needed the money because “Santa needed to pay his elves.”

According to witnesses, the suspect was clumsy and seemed jovial.

In 2015, Darth Vader robbed a Credit Union in North Carolina, but he wasn’t the first Darth Vader to commit such an act, and again, certainly not the first costumed robber.

In 2011 in San Diego, Gumby just wanted some smokes and a little change. He left peacefully.

Teletubbies can be dangerous too. In 2014, Yellow Teletubby Lala broke into a friend’s house and stole Chinese food out of the fridge, making a getaway after pouring the food into his man purse. (The report was confusing because Lala doesn’t typically carry a purse.) But Lala was not the first Teletubby to terrorize the public. A Canadian woman reported being held up by the purple teletubby known as Tinky Winky in 2009.

Blood Suckers in Malawi Termed Mass Hysteria; Monkey Man a Similar Case

The Society of Medical Doctors in Malawi is now speaking out publicly to declare the current fear of blood suckers to be a case of “mass hysteria” also known as “shared delusion disorder.”

In a statement, society president Dr. Amos Salimanda Nyaka said: “We are disturbed by the reports of thuggery that has resulted into some health workers being attacked for carrying a stethoscope. Some have had unfortunate incidences of having their vehicles smashed, and in others having their possessions taken off them for being suspected of being blood suckers, and or in pursuit of the non-existent suckers. Some ambulances have also been attacked whilst being used to ferry patients to and or from hospital.”

The society also criticized Malawi President Peter Mutharika and the Malawi media for not fully denouncing the fear of vampires as nonsense and appealing to reason. Mutharika later came out in a more direct statement to the country addressing the rumors as both a hoax and an opportunity to enter homes and rob innocent people.

Since the panic began in late summer of this year, more than nine people have been killed and more than 100 have been arrested.

THE MONKEY MAN OF NEW DEHLI, 2001

A similar mass hysteria occurred in New Dehli when, in May of 2001, police began receiving inconsistent reports of a clawed entity with glowing red eyes. Some described it as feline-like, while others felt it was a monkey-man. Sometimes it was described wearing a helmet. Folks began to report unexplained bite-like injuries, scratches and bruises, and at least two people died in falls trying to escape the creature. Early on, more than 50 attacks were reported to have occurred in a single night.

Just as in Malawi, the reports in New Dehli began to spread to more and more locations. Also, like Malawi areas affected by blood sucking vampires, most residents were illiterate, superstitious, and often isolated in rural areas with no electric lighting. Also similar to the Malawi situation, there was a belief that rumors were being deliberately created by a foreign source or for a nefarious political motivation. In both cases, the police were severely taxed, forced to patrol areas to control panic as well as make those in genuine fear feel protected.

While at least nine people in Malawi have been killed by mobs on suspicion of being bloodsuckers, in New Dehli an innocent four foot tall man was beaten and delivered to the police. Later, a man driving a van was beaten and suffered multiple broken bones.

At one point, a neighboring village in India reported a wolf-like Bear Man was also attacking citizens. The Bear Man would become invisible if a light were shone upon him.

B-52 Bombers: A Brief History and Today’s Status

Mission
The B-52 is a long-range, heavy bomber that can perform a variety of missions. The bomber is capable of flying at high subsonic speeds at altitudes up to 50,000 feet (15,166.6 meters). It can carry nuclear or precision guided conventional ordnance with worldwide precision navigation capability.

Features
In a conventional conflict, the B-52 can perform strategic attack, close-air support, air interdiction, offensive counter-air and maritime operations.
During Desert Storm, B-52s delivered 40 percent of all the weapons dropped by coalition forces. It is highly effective when used for ocean surveillance, and can assist the U.S. Navy in anti-ship and mine-laying operations. Two B-52s, in two hours, can monitor 140,000 square miles (364,000 square kilometers) of ocean surface.

All B-52s can be equipped with two electro-optical viewing sensors, a forward-looking infrared and advanced targeting pods to augment targeting, battle assessment, and flight safety, thus further improving its combat ability.

Pilots wear night vision goggles, or NVG, to enhance their vision during night operations. Night vision goggles provide greater safety during night operations by increasing the pilot’s ability to visually clear terrain, to increase the peacetime and combat situational awareness of the aircrew and visually acquire other aircraft.

B-52s are currently upgrading from the Litening Advanced Targeting Pod to the Sniper Advanced Targeting Pod.  Sniper pods provide improved long-range target detection/identification and continuous stabilized surveillance for all missions, including close air support of ground forces.  The pod’s advanced targeting and image processing technology significantly increases the combat effectiveness of the B-52 during day, night and under-the-weather conditions in the attack of ground targets with a variety of standoff weapons (i.e., laser-guided bombs, conventional bombs and GPS-guided weapons).

The use of aerial refueling gives the B-52 a range limited only by crew endurance. It has an unrefueled combat range in excess of 8,800 miles (14,080 kilometers).

Background
For more than 40 years, B-52 Stratofortresses have been the backbone of the manned strategic bomber force for the United States. The B-52 is capable of dropping or launching the widest array of weapons in the U.S. inventory. This includes gravity bombs, cluster bombs, precision guided missiles and joint direct attack munitions. Updated with modern technology the B-52 will be capable of delivering the full complement of joint developed weapons and will continue into the 21st century as an important element of our nation’s defenses. Current engineering analyses show the B-52’s life span to extend beyond the year 2040.

The B-52A first flew in 1954, and the B model entered service in 1955. A total of 744 B-52s were built with the last, a B-52H, delivered in October 1962. The first of 102 B-52H’s was delivered to Strategic Air Command in May 1961. The H model can carry up to 20 air launched cruise missiles. In addition, it can carry the conventional cruise missile that was launched in several contingencies during the 1990s, starting with Operation Desert Storm and culminating with Operation Iraqi Freedom.

The aircraft’s flexibility was evident in Operation Desert Storm and again during Operation Allied Force. B-52s struck wide-area troop concentrations, fixed installations and bunkers, and decimated the morale of Iraq’s Republican Guard. On Sept. 2 to 3, 1996, two B-52Hs struck Baghdad power stations and communications facilities with 13 AGM-86C conventional air launched cruise missiles, or CALCMs, as part of Operation Desert Strike. At that time, this was the longest distance flown for a combat mission involving a 34-hour, 16,000 statute mile round trip from Barksdale Air Force Base,Louisiana.

In 2001, the B-52 contributed to the success in Operation Enduring Freedom, providing the ability to loiter high above the battlefield and provide close air support through the use of precision guided munitions.

The B-52 also played a role in Operation Iraqi Freedom. On March 21, 2003, B-52Hs launched approximately 100 CALCMs during a night mission.

Only the H model is still in the Air Force inventory and is assigned to the 5th Bomb Wing at Minot AFB, North, Dakota, and the 2nd Bomb Wing at Barksdale AFB, which fall under Air Force Global Strike Command. The aircraft is also assigned to the Air Force Reserve Command’s 307th Bomb Wing at Barksdale AFB.

When he first began his U.S. Air Force career, Lt. Col. Steven R. “Thirsty” Smith never expected to be flying the Boeing B-52 Bomber, let alone flying it for 30 years. Yet on March 3, 2017, he exceeded more than 10,000 flight hours in the iconic bomber, more than any other aviator currently serving in the Air Force. In fact, it’s a milestone that has not been accomplished since the Vietnam era.

With 496 combat hours beginning during Operation Desert Storm, Lt. Col. Smith describes the B-52 as a solid jet he will enjoy flying for several more years. Now an instructor with the 93rd Bomb Squadron, he’s training the next generation who will fly the aircraft into the future. Because the United States Air Force and Boeing are partnering to modernize and transform the B-52 for today’s flight, the aircraft, with accomplished pilots like Thirsty Smith at the controls, will continue to serve as the backbone of the nuclear and conventional bomber force for many years to come, to 2050 and beyond.

Antifa Parody Accounts

Antifa parody accounts have quietly existed for some time, spoofing Antifascist activism via Twitter, Facebook and YouTube.

But one now suspended account, @antifaboston, caused all sorts of confusion and embarrassment when in September mainstream media mistook it for a Russian operative account spreading disinformation. Hysteria over Russian interference in social media peaked when someone noticed the Boston Antifa Twitter account had geo-tagged itself as originating in Vladivostok, Russia.

Even Chris Hayes of MSNBC got caught in the crossfire when he reported on the “Russian” account, later admitting on Twitter, “yeah that wasn’t my best performance.” Likewise, Oklahoma Senator James Lankford was duped.

 

According to North Shore Antifa, which claims to be a true Antifa account representing the Boston area, “Boston Antifa” no longer has an active Facebook page nor any other social media, any existing pages are fascist honeypots or troll accounts spreading misinformation. Please do not interact with these pages or share their content, however monitor their activity as precaution.

JFK Assassination Records Processing Project

The National Archives and Records Administration (NARA) Commits to Processing the Withheld JFK Assassination Records by October 26, 2017

Background

When Congress passed the JFK Assassination Records Collection Act in 1992 agencies throughout the Federal Government transferred assassination-related records to the National Archives which established the JFK Assassination Records Collection. The Collection consists of approximately 5 million pages of records. Approximately 88% of the records in the Collection are open in full. An addition 11% are released in part with sensitive portions removed. Approximately 1% of documents identified as assassination-related remain withheld in full. All documents withheld either in part or in full were authorized for withholding by the Assassination Records Review Board (ARRB), an independent temporary agency that was in existence from 1994 to 1998.

According to the Act, all records previously withheld either in part or in full should be released on October 26, 2017, unless authorized for further withholding by the President of the United States. The 2017 date derives directly from the law that states:

Each assassination record shall be publicly disclosed in full, and available in the Collection no later than the date that is 25 years after the date of the enactment of this Act, unless the President certifies, as required by this Act, that –

(i) continued postponement is made necessary by an identifiable harm to military defense, intelligence operations, law enforcement or conduct of foreign relations; and

(ii) the identifiable harm is of such gravity that it outweighs the public interest in disclosure.

The Act was signed by President Bush on October 26, 1992, thus the final release date is October 26, 2017.*

The JFK 2017 Processing Team

In October of 2014, after conducting an initial pre-processing evaluation of the withheld materials, the National Archives constituted a dedicated team of four (4) archivists to process withheld JFK Assassination-related records in preparation for the 2017 release of additional materials. NARA has hired three (3) additional technicians to assist with digitizing the withheld materials.

The Team is conducting archival processing on the documents to prepare the records for scanning. Agencies with equities in the withheld materials have been notified that previously withheld documents will be released in 2017 absent a successful appeal to the President. The staff is working with NARA’s Office of Innovation to determine the best way to present the documents through archives.gov when released in 2017.

Once the digital release is completed the hard copy documents will be interfiled into the five million pages of the paper Collection.

FAQs about John F. Kennedy Assassination Records Collection Act of 1992 Collection and the 2017 release

The President created the Assassination Records Review Board (ARRB) as an independent agency to re-examine for release the assassination-related records that federal agencies still regarded as too sensitive to open to the public. The Board finished its work on September 30, 1998, issued a final report, and transferred all of its records to the National Archives and Records Administration.

What does the John F Kennedy Assassination Records Collection Act of 1992 say about the release of assassination records?

According to the Act, all records that were previously authorized for withholding by the ARRB are to be released no later than 25 years after the signing of the Act, unless the President authorizes further withholding. That date is October 26, 2017. Agencies who would like their information withheld for longer, need to file a formal appeal with the President.

Have any agencies appealed the release of their records?

As of March, 2017, NARA has not been notified that any agency has appealed release of their documents. However, it is our understanding that agencies are still reviewing the documents subject to release in October 2017.

What is going to be released before October?

We still have not determined whether or how many records will be released before the October deadline. The law states that the records must be released or authorized for further withholding no later than 25 years after the signing of the act. Nothing in the law precludes or requires a release prior to that date. We are hopeful that there will be files that can be proactively released before the October 26, 2017 deadline, but are awaiting formal determinations from the agencies.

Where is the withdrawn material physically kept?

Agencies transferred the withheld material to NARA. NARA stores the records in security-classified stacks at the National Archives at College Park.

How likely is it that there could be a major revelation in the material?

The ARRB considered the relevancy of each document to the assassination events when they determined which documents would be released during their tenure and which could be postponed until 2017. The ARRB cast a wide net in what they considered assassination related and included records on topics not specifically related to the assassination and the investigations into the assassination. While NARA cannot comment on the content of the records, we assume that much of what will be released will be tangential to the assassination events.

Are we going to see everything, or will some documents remain secret forever?

NARA is trusted with preserving our archival holdings permanently and holds that all records in our legal custody will eventually be available for research. That said, there are categories of records in the collection that, in accordance with the Act, will not be released in 2017. Sections 10 and 11 of the act discuss grand jury information and records held under section 6103 of the Internal Revenue Code (tax return information) as well as records covered by a specific deed of gift. We have identified a small number of records, or portions of records, that fit into these categories. For all other records, how long records stay withheld after 2017 will be determined by the President, who has final appeal authority.

What is NARA’s role?

The staff of the National Archives is focused on ensuring that we do everything in our power to facilitate the processing of these records. Our goal is to provide the support that the agencies and the President need to meet the requirements of the Act and to expeditiously release the records as soon as we are authorized to do so.

The Sunday Sessions: Documentary Explores Conversion Therapy

THE SUNDAY SESSIONS is an intimate portrait of one man’s struggle to reconcile his religious conviction and sexual identity. The observational documentary chronicles the turbulent journey of a devoutly Catholic gay man as he attends conversion therapy in hopes of changing his sexual orientation.

Conversion therapy is the controversial, non-scientifically based process which aims to convert an individual’s sexual orientation from homosexual to heterosexual. Although it has been discredited by all major American medical, psychiatric, psychological and professional counseling organizations, some therapists still offer the service for reasons almost exclusively rooted in a conservative religious belief system.

The filmmakers had unfettered access to individual therapy sessions, family sessions, and a collection of weekend camps, and have crafted an emotional and psychological thriller which chronicles two years of Nathan’s journey from acceptance to skepticism, all leading to a profound epiphany.
