QUESTION PRESENTED:
Jack Phillips is a cake artist. The Colorado Civil Rights Commission ruled that he engaged in sexual orientation discrimination under the Colorado Anti- Discrimination Act (“CADA”) when he declined to design and create a custom cake honoring a same-sex marriage because doing so conflicts with his sincerely held religious beliefs.
The Colorado Court of Appeals found no violation of the Free Speech or Free Exercise Clauses because it deemed Phillips’ speech to be mere conduct compelled by a neutral and generally applicable law. It reached this conclusion despite the artistry of Phillips’ cakes and the
Commission’s exemption of other cake artists who declined to create custom cakes based on their message. This analysis (1) flouts this Court’s controlling precedent, (2) conflicts with Ninth and Eleventh Circuit decisions regarding the free speech protection of art, (3) deepens an existing conflict between the Second, Third, Sixth, and Eleventh Circuits as to the proper test for identifying expressive conduct, and (4) conflicts with free exercise rulings by the Third,
Sixth, and Tenth Circuits.

The question presented is: Whether applying Colorado’s public accommodations law to compel Phillips to create expression that violates his sincerely held religious beliefs about marriage violates the Free Speech or Free Exercise Clauses of the First Amendment.

On December 5, 2017, the United States Supreme Court will hear oral arguments on whether a business open to the public has a constitutional right to discriminate.

David Mullins and Charlie Craig visited Masterpiece Cakeshop in July 2012, with Charlie’s mother, to order a cake for their upcoming wedding reception. Dave and Charlie planned to marry in Massachusetts and then celebrate with family and friends back home in Colorado. But bakery owner Jack Phillips informed them that the bakery wouldn’t sell wedding cakes to same-sex couples.

Longstanding Colorado state law prohibits public accommodations, including businesses open to the public such as Masterpiece Cakeshop, from refusing service based on characteristics like race, religion, orsexual orientation. Dave and Charlie filed complaintswith the Colorado Civil Rights Division contendingthat the bakery violated

Colorado’s Anti-Discrimination Act. Following an investigation and hearings, the Colorado Civil Rights Commission determined that the bakery illegally discriminated against Dave and Charlie when it refused them service.

On August 13, 2015, the Colorado Court of Appeals unanimously affirmed the Commission’s order, finding that the bakery discriminated because of sexual orientation in violation of state law. The court also concluded that application of Colorado’s Anti-Discrimination Act did not infringe the bakery’s freedom of speech or free exercise of religion. The Colorado Supreme Court denied review, and the United States Supreme Court granted certiorari on June 26, 2017.

Status: After victories for equality at every stage of the case, the United States Supreme Court will hear oral argument on December 5, 2017. In advance of oral argument, more than 40 friend-of-the-court briefs were filed in support of Dave and Charlie.

Highlights Scholar-Mentor Research Model

WASHINGTON, Aug. 8, 2016—Today Brill, a leading international academic publisher, released the first in a series of volumes based on research sponsored by Museum of the Bible. Edited by Emanuel Tov (Hebrew University, Jerusalem), Kipp Davis (Trinity Western University) and Robert Duke (Azusa Pacific University), the volume contains findings on 13 previously unpublished Dead Sea Scrolls fragments, a number of Hebrew Bible fragments and one non-biblical fragment. It is the culmination of four years of research that involved some 50 scholars comprised of a core editorial team, 11 chapter authors and 35 co-authors.

Museum of the Bible sponsors research through its Scholars Initiative, which facilitates a global network of scholars to pursue research and provide students with an opportunity to develop as scholars under the guidance of scholar-mentors. Key to this research model is the involvement of leading international scholars who provide supervision and oversight.

Museum of the Bible enlisted the world’s leading expert on Dead Sea Scrolls to supervise the editing and publication of this Scholars Initiative research project. Tov is considered the world’s leading authority on textual criticism of Hebrew and Greek Bibles, as well as the Qumran Scrolls, and served as editor-in-chief of the international Dead Sea Scrolls publication project.

The team of emerging scholars working on this Museum of the Bible Scholars Initiative research project, many of whom had never delved into the Dead Sea Scrolls, operated in an incredibly professional way,” said Tov. “With supervisory guidance, they produced strong results and, in my opinion, this mentoring system of the Scholars Initiative was a great success.”

The editors and their team have produced a masterful edition of 13 Judean Desert fragments, most probably from Qumran and almost all from the Hebrew Scriptures,” said Dr. Lawrence Schiffman, a renowned Dead Sea Scrolls scholar who serves at New York University as the Judge Abraham Lieberman Professor of Hebrew and Judaic Studies, Skirball Department of Hebrew and Judaic Studies, and Director of the Global Network for Advanced Research in Jewish Studies. “They have brought to bear the best of scientific and textual methods available to their task. While testifying to the various forms of the text of the Hebrew Bible known from Antiquity, these fragments point toward the dominance of the proto-Masoretic text by the end of the first century CE.

Museum of the Bible has made an excellent start in their publication program, and further volumes are eagerly awaited.”

The 236-page Brill volume, which contains five tables and 41 photographs and is titled “Dead Sea Scrolls Fragments in the Museum Collection,” explains how this mentoring model is built around three levels of participants: students (undergraduate through doctorate), their professors, and senior scholars who consult on projects in their areas of expertise. The Scholars Initiative structure also includes regional directors, who assist senior scholars and professors on their local campuses, and distinguished scholars, who are established language specialists.

Also of note in this new Brill publication is the advanced use of digital imaging for the reconstruction of the texts that was provided by the West Semitic Research Project for the University of Southern California. The reconstructive process, which applied evolving imaging technologies with new methodologies, offered researchers an unparalleled means for testing various proposals for how a text was originally laid out with a degree of precision and accuracy heretofore not possible.

To date through the Scholars Initiative, professors from more than 60 international universities and seminaries have participated in some 90 research projects on biblical texts and artifacts, many of which have never been studied before. The Scholars Initiative involves leading experts in the fields of papyri; Aramaic, Greek, Latin, Hebrew, Egyptian and Ethiopic texts; and Coptic, medieval, Middle-Eastern, early Jewish and early American artifacts, among others.

This is the first in a series of Brill volumes dedicated to research on items in the Museum of the Bible Collection. The next volume is dedicated to some of the collection’s early Greek texts and will be published soon, with Jeffrey Fish (Baylor University) serving as editor.

The Museum Collections include artifacts and objects from a range of cultures and time periods, from the Ancient Near East to the modern period. Religious Privilege Around the World: Pew Research

Many Countries Favor Specific Religions, Officially or Unofficially

Islam is the most common state religion, but many governments give privileges to Christianity

More than 80 countries favor a specific religion, either as an official, government-endorsed religion or by affording one religion preferential treatment over other faiths, according to a new Pew Research Center analysis of data covering 199 countries and territories around the world.1

Islam is the most common government-endorsed faith, with 27 countries (including most in the Middle East-North Africa region) officially enshrining Islam as their state religion. By comparison, just 13 countries (including nine European nations) designate Christianity or a particular Christian denomination as their state religion.

But an additional 40 governments around the globe unofficially favor a particular religion, and in most cases the preferred faith is a branch of Christianity. Indeed, Christian churches receive preferential treatment in more countries – 28 – than any other unofficial but favored faith.

In some cases, state religions have roles that are largely ceremonial. But often the distinction comes with tangible advantages in terms of legal or tax status, ownership of real estate or other property, and access to financial support from the state. In addition, countries with state-endorsed (or “established”) faiths tend to more severely regulate religious practice, including placing restrictions or bans on minority religious groups.

In 10 countries, the state either tightly regulates all religious institutions or is actively hostile to religion in general. These countries include China, Cuba, North Korea, Vietnam and several former Soviet republics – places where government officials seek to control worship practices, public expressions of religion and political activity by religious groups.

Most governments around the globe, however, are generally neutral toward religion. More than 100 countries and territories included in the study have no official or preferred religion as of 2015. These include countries like the United States that may give benefits or privileges to religious groups, but generally do so without systematically favoring a specific group over others.

These are among the key findings of a new Pew Research Center analysis of country constitutions and basic laws as well as secondary sources from governmental and nongovernmental organizations.

  • States with no official or preferred religion seek to avoid giving tangible benefits to one religious group over others (although they may evenhandedly provide benefits to many religious groups). For example, the U.S. government gives tax exemptions to religious organizations under rules that apply equally to all denominations. Many countries in this category have constitutional language calling for freedom of religion, although that language alone is not enough to include a country in this group; coders must determine that these countries do not systematically favor one or more religions over others.

This latest ad of Meat & Livestock Australia in the “You’ll Never Lamb Alone” series, it is very insensitive, irresponsible and total nonsense.

Not only it is defaming the religion, it is also highly inappropriate for, Hindu’s, Muslim’s and Buddhist’s as well. So to say all the religions.

Soon this 30-second ad, will be a part of a broader marketing strategy that will also include in-store promotions, billboards and social media posts.

This should be stopped immediately, it can not be accepted whatsoever. We urge to the PM of Australia to please look into this matter at the earliest before it catches eye of foreign media and embrace the racist image of the country world wide.

Lord Ganesha in Lamb Advertisement Hurts Religious Sentiments

The ad also includes Jesus, Scientology founder L. Rob Hubbard, Thor and Zeus. Titled “You Never Lamb Alone”,  the ad was launched by Meat and Livestock Australia (MLA) on September 4, 2017.

The High Commission of India, Canberra, taking note of the protests of Indian community in Australia, have made a demarche to the Department of Foreign Affairs and Trade, Department of Communication and Arts and Department of Agriculture bringing to their notice an offensive advertisement by Meat and Livestock Australia that hurt the religious sentiments of the Indian community.

In a video advertisement released by Meat and Livestock Australia recently, Lord Ganesha along with other religious figures is found to be ‘toasting lamb’, which the Indian community consider to be offensive and hurting their religious sentiments.

The Consulate General of India in Sydney has taken up the matter directly with Meat and Livestock Australia and urged them to withdraw the advertisement.

A number of Community Associations have also registered their protest with Government of Australia and Meat and Livestock Australia.

PRRI Releases Largest Survey of American Religious and Denominational Identity Ever Conducted

Survey of 101,000 Americans chronicles the country’s changing religious landscape, including the declining dominance of white Christian groups and a more diverse future

WASHINGTON—With aging white Christian groups now accounting for fewer than half of the public and non-Christian groups constituting the country’s youngest religious communities, the future of American religion will likely look strikingly different than its past. A massive new survey out today from PRRI reveals seismic shifts in the religious landscape over the last few decades, including the sharp growth of the religiously unaffiliated—a category that includes atheists, agnostics, and those who say they do not identify with any particular religion—along with racial and ethnic changes that are transforming nearly all major Christian denominations.

These are among the major findings from “America’s Changing Religious Identity,” a report released today by PRRI. The report is based on findings from PRRI’s 2016 American Values Atlas, the single largest survey of American religious and denominational identity ever conducted, based on interviews with more than 101,000 Americans from all 50 states conducted across 2016. The report includes detailed information about religious affiliation, denominational ties, political affiliation, and other important demographic characteristics.

“This report provides solid evidence of a new, second wave of white Christian decline that is occurring among white evangelical Protestants just over the last decade in the U.S.,” says Robert P. Jones, PRRI CEO and author of The End of White Christian America. “Prior to 2008, white evangelical Protestants seemed to be exempt from the waves of demographic change and disaffiliation that were eroding the membership bases of white mainline Protestants and white Catholics. We now see that these waves simply crested later for white evangelical Protestants.”

Today, only 43% of Americans identify as white Christian, and only 30% as white Protestant. In 1976, roughly eight in ten (81%) Americans identified as white and identified with a Christian denomination, and a majority (55%) were white Protestants.

Fewer than one in five (17%) Americans now identify as white evangelical Protestant, but they accounted for nearly one-quarter (23%) of the public just a decade ago in 2006. Over the same period, white Catholics dropped five percentage points from 16% to 11%, and white mainline Protestants have shed an equal number, decreasing from 18% to 13%.

The Catholic Church is also undergoing a dramatic transformation as its share of white, non-Hispanic members dwindles and its Hispanic membership rises. Twenty-five years earlier in 1991, nearly nine in ten (87%) Catholics were white, non-Hispanic, compared to 55% today. Among Catholics under the age of 30, fewer than four in ten (36%) are white, non-Hispanic, compared to 52% who are Hispanic.

More evidence that America’s future is less white and less Christian: Muslims, Hindus, Buddhists, and the religiously unaffiliated are all far younger than white Christian groups. At least one-third of Muslims (42%), Hindus (36%), and Buddhists (35%) are under the age of 30. Roughly one-third (34%) of religiously unaffiliated Americans are also under 30. In contrast, slightly more than one in ten white Catholics (11%), white evangelical Protestants (11%), and white mainline Protestants (14%) are under 30.

“The unprecedented growth of the religiously unaffiliated has made this group much more complex,” said PRRI Research Director Dan Cox. “For example, atheists and agnostics, two of the most known subgroups among the unaffiliated, account for just a sliver of the entire group.”

Atheists and agnostics account for only about one-quarter (27%) of all religiously unaffiliated Americans. Nearly six in ten (58%) religiously unaffiliated Americans identify as secular, or someone who is not religious; 16% of religiously unaffiliated Americans nonetheless report that they identify as a “religious person.”

Additional findings:

  • Non-Christian religious groups are growing, but they still represent less than one in ten Americans combined. Jews constitute 2% of all Americans while Muslims, Buddhists, and Hindus each constitute only 1% of the public. All other non-Christian religions constitute an additional 1%.
  • There are now 20 states in which no religious group comprises a greater share of residents than the religiously unaffiliated. These states tend to be more concentrated in the western U.S., although they include a few New England states, as well. More than four in ten (41%) residents of Vermont and approximately one-third of Americans in Oregon (36%), Washington (35%), Hawaii (34%), Colorado (33%), and New Hampshire (33%) are religiously unaffiliated.
  • No state is less religiously diverse than Mississippi. The state is heavily Protestant and dominated by a single denomination: Baptist. Six in ten (60%) Protestants in Mississippi are Baptist. No state has a greater degree of religious diversity than New York.
  • The cultural center of the Catholic Church is shifting south. The Northeast is no longer the epicenter of American Catholicism—although at 41% Catholic, Rhode Island remains the most Catholic state in the country. Immigration from predominantly Catholic countries in Latin America means new Catholic populations are settling in the Southwest. In 1972, roughly seven in ten Catholics lived in either the Northeast (41%) or the Midwest (28%). Only about one-third of Catholics lived in the South (13%) or West (18%). Today, a majority of Catholics now reside in the South (29%) or West (25%). Currently, only about one-quarter (26%) of the U.S. Catholic population lives in the Northeast, and 20% live in the Midwest.
  • Jews, Hindus, and Unitarian-Universalists stand out as the most educated groups in the American religious landscape. More than one-third of Jews (34%), Hindus (38%), and Unitarian-Universalists (43%) hold post-graduate degrees. Notably, Muslims are significantly more likely than white evangelical Protestants to have at least a four-year college degree (33% vs. 25%, respectively).
  • Asian or Pacific-Islander Americans have a significantly different religious profile than other racial or ethnic groups. There are as many Asian or Pacific-Islander Americans affiliated with non-Christian religions as with Christian religious groups. And one-third (34%) are religiously unaffiliated.
  • Nearly half of LGBT Americans are religiously unaffiliated. Nearly half (46%) of Americans who identify as lesbian, gay, bisexual, or transgender (LGBT) are religiously unaffiliated. This is roughly twice the number of Americans overall (24%) who are religiously unaffiliated.
  • White Christians have become a minority in the Democratic Party. Fewer than one in three (29%) Democrats today are white Christian, compared to half (50%) one decade earlier. Only 14% of young Democrats (age 18 to 29) identify as white Christian. Forty percent identify as religiously unaffiliated.
  • White evangelical Protestants remain the dominant religious force in the GOP. More than one-third (35%) of all Republicans identify as white evangelical Protestant, a proportion that has remained roughly stable over the past decade. Roughly three-quarters (73%) of Republicans belong to a white Christian religious group.

Methodology

The 2016 American Values Atlas (AVA) is a project of PRRI. Results were based on 101,438 bilingual telephone interviews (including 60,355 cell phone interviews) conducted between January 6, 2016 and January 10, 2017 by professional interviewers under the direction of SSRS.
